This Agreement will be in effect starting on the latter of the date of payment and the provision to Service Provider of the information needed to provide service and will continue until the last report is done one year from the starting date. The Agreement shall renew annually, unless terminated earlier upon completion of services or upon Client request. Service Provider is only obligated to provide services during the period for which it has been paid
Service Levels:
​The Service Provider agrees to meet or exceed of the following service level performance by:
Quality of Performance (people search on website) and no delays on quarterly reports (please understand that people search sometimes takes between 3 - 5 weeks for removal)
​​Completion of reports and receive quarterly reports.
Reporting - Service Provider and Client’s designated representatives.
Response rates of inquiries and requests in a timely manner.
Service Provider is allowed to refuse services, if the Client misuses the service, or takes actions that would interfere with the Service Provider’s services. In such case, the Service Provider will have no further obligation to the Client and may refuse further services. These steps are taken to ensure the integrity of our services as to the vast majority of our clients who seek to legitimately protect their privacy.
Performance Monitoring:
The representative chosen by the Parties shall be responsible for monitoring the information from the websites, ensuring that the expectations are met and based on predetermined standards. Any service level fallen short of expectation is to be considered basis to a default service notice to the Client by the Service Provided.
Payment Terms:
The Client party agrees to pay the amount set forth on its pricing schedule then in force on the Service Provider’s website. Payment shall be made in the manner designated on the website. The Client must pay before any services will be provided.
Confidentiality:
The Parties agree that any information that is given between the Client to Service Provider will remain strictly confidential and proprietary among the Parties, and only used as provided in its Privacy Policy which can be reviewed here (insert link).
Communications:
The Parties agree to communicate electronically or by telephone, there being no requirement for notifications on paper or by US Mail.
Capacity, Liability and Governing Law:
The person signing below for Client represents that he or she is over the age of 18, has Client authority and legal capacity to agree on behalf of Client, and that the information provided by Client is true, accurate and up to date, and that Client will comply at all times with the terms set forth and applicable law. In the event of dispute or legal action, the maximum liability of Service Provider to Client shall not exceed the amount paid by Client for service. Client agrees to indemnify, defend and hold harmless Service Provider from and against all claims, liabilities, damages, losses that such parties may incur as a result of Client’s violation or breach of any representation or obligation under this Agreement. This Agreement is governed by the law of the State of Nevada and will bind and benefit the Parties.
